Opulent Staffing Terms and Conditions

This Terms and Conditions Contract is between and Employer/Client, herein after to be called the ‘Client’ help 14589554 Opulent Staffing the owner of the recruitment agency. A Client is defined as a person(s) who approaches Opulent Staffing either via verbal or written instruction and requests Opulent Staffing to introduce the Client to a Candidate for the purpose of employment.

If you do not choose to hire one of our Candidates, there will be no fee payable.

By registering with Opulent Staffing either verbally or through written instruction the Client accepts wholly and understands Opulent Staffing’s Terms and Conditions of Opulent Staffing is transacted subject to the conditions herein set out each of which shall be incorporated and implied by any agreement with Opulent Staffing.

Services

Opulent Staffing will introduce a Candidate to carry out work for the Client of such nature as notified by the Client. Upon placing this request, the Client will specify its exact requirements by providing the full details of the work for which the Candidate is needed to carry out.

The Client shall notify Opulent Staffing immediately should it choose to engage a Candidate introduced or supplied by Opulent Staffing. As a result of such engagement, the Client agrees to pay a placement fee in accordance with Opulent Staffing’s Fee Structure.

The introduction of a Candidate to a Client by Opulent Staffing, directly or indirectly, is confidential and such introductions are made individually. If the Client or a member of the Clients staff or any acquaintance or associate of the Client, passes on an introduction to any other person or persons within six months of the Candidates introduction to the Client by Opulent Staffing, resulting in the engagement of the Candidate, the Client shall be liable for the payment of the full fee in accordance with the Opulent Staffing’s Fee Structure for permanent placements.

Opulent Staffing is run by experienced recruitment consultants with substantial experience in successful private staff placements to ensure, but cannot guarantee, the suitability of any candidate introduced by Opulent staffing to the Client. Suitability includes, but is not limited to, a Candidates character, honesty, reliability or professional capacity. Opulent Staffing accepts no liability for any loss, damage, expense or compensation suffered or incurred of any nature by the Client, arising directly or indirectly from and act or omission by any Candidate introduced to the Client by Opulent Staffing. We do arrange enhanced DBS’s for our successfully placed permanent Candidates if the certificate they hold is over a year old. However we are unable to accelerate the enhanced DBS return once we have submitted it and it is in progress.

Replacement Candidate

If, after an offer has been made and accepted, the Engagement (a)does not commence because the Candidate withdraws their acceptance; or (b)once it has commenced, it is terminated by either the Candidate or the Client (except in redundant) within 8 weeks of the commencement date, the agency will endeavor, without additional charge to find one suitable Replacement Candidate based on the original specification given for the position the Client is seeking to fill. (ie “like-for-like” replacement). If a suitable Replacement Candidate is engaged the Client will remain only liable for the original introduction fee, based on the original Engagement, and no additional introduction fee shall be charged unless the Replacement Candidates Remuneration is higher that that of the original Candidate.

In order to qualify for a Free Replacement Candidate the Client must;

  1. Notify Opulent Staffing in writing of the termination of the Engagement or the non-commencement of the Engagement within 48 hours of it’s termination or non commencement.

  2. The work the Candidate was Engaged for was as set out and agreed prior to the offer of Engagement.

  3. The Candidate did not leave the Engagement due to discrimination, violence or other acts against the candidate.

  4. The Candidate has been paid up-to-date according to their contract to include but not limited to their notice period and any provisions purchased for the household including travel expenses incurred during the course of their duties.

  5. The Engagement is terminated by either the Client or Candidate.

  6. The Engagement can not have terminated (or offer of Engagement have been withdrawn) for reason of personality clash, the role being made redundant or the household being reconstructed.

  7. The date of termination of the Engagement shall be the date on which the Candidate ceases working or would have ceased working for the Client, but for any period of garden leave or payment in lieu of notice, whichever is the later.

  8. In circumstances where there is a late payment of placement fee, there shall be no entitlement to a free replacement.

If the Client has not met the above conditions (1) to (8), the Client is responsible for full payment of the initial placement’s invoice and no free replacement is due.

Fee Structure

The Client holds full responsibility for informing Opulent Staffing immediately upon enlisting the Candidate’s services whether the Client intends to engage the Candidate on a permanent or temporary basis. Unless specifically stated by the Client, a request for a permanent Candidate will be assumed by Opulent Staffing, and the applicable fee will be charged to the Client.

  1. Should the Client choose to engage a permanent Candidate within the UK, Opulent Staffing charges a fee of 14% of their gross annual salary is payable within 7 days of the date of the invoice or 48 hours prior to the Engagement Commencement whichever is sooner. If the payment has not been fully settled by 7 days or the Engagement Commencement, whichever is sooner. Then and additional 15% will be added to the invoice and it may delay the start of the Candidate and will affect the free replacement policy.

  2. Should the Client choose to engage a temporary Candidate within the UK Opulent Staffing charges a fee of £200 per week/part-week for the duration of the employment (under 12 weeks), which is payable within 7 days of the date of the invoice or 48 hours prior to the Engagement Commencement whichever is sooner, if the payment has not been fully settled by 7 days or the Engagement Commencement, whichever is sooner. Then an additional 15% will be added to the invoice and it may delay the start of the Candidate and will affect the free replacement policy.

  3. Should the Client choose to engage a candidate abroad (outside of the UK), Opulent Staffing charges a fee of 18% of the gross annual salary is payable within 7 days of the date of the invoice or 48 hours prior to the Engagement Commencement whichever is sooner. If payment has not been fully settled by 7 days of Engagement Commencement whichever is sooner. Then and additional 15% will be added to the invoice and it may delay the start of the Candidate and will affect the free replacement policy. It is the Clients responsibility to check and provide all relevant work permits/visas if the Candidate is asked to accompany the family overseas for any reason. Opulent Staffing cannot be held responsible for arranging or advising over this issue.

  4. There are no refunds due, should the Client cancel the booking or reduce the days required once the booking has been made and confirmed of both sides.

  5. Opulent Staffing will issue an invoice after the Client has accepted a Candidate – verbally or through written instruction – for employment. Fees are payable by the Client within 7 days of the invoice being issued. For all fees not settled in accordance with Opulent staffing Terms and Conditions of Business are subject to additional 15% surcharge on each re-invoice which may occur every 7 days. This is cumulative and will be added to each invoice until it is paid.
